This is an amendment to the master declaration for Centerpointe at Deer Valley, a commercial/mixed-use development in Phoenix consisting of five lots owned by separate entities. It modifies easements, parking rules, sign requirements, and utility provisions. This document does not contain typical residential rules.
- Cross-access easements: Revised Exhibit 'B' defines cross-access easements for vehicles and pedestrians between lots, ensuring shared driveway and roadway access.
- Parking restrictions (Lots 3 & 4): Lots 3 and 4 are not subject to cross parking easements between 6:00 pm and 6:00 am, meaning overnight parking from those lots on other lots is not allowed.
- Common landscape areas: Certain areas (shown on Exhibit 'C') are designated as common property landscaping, with maintenance and replacement costs shared pro-rata by all lot owners via association assessments.
- Signs (monument & identification): Lot owners must construct and maintain monument signs per a comprehensive sign plan approved by the City and an Architectural Review Committee. Lots 3 and 4 share costs for one monument sign. All signs, including temporary banners, must comply with city rules and the sign plan.
- Utility easements & cost sharing: Perpetual utility easements are granted across lots for installation and maintenance. Onsite utility improvement costs are shared pro-rata, with failure to pay leading to a lien.
