Encata Owners Association is a single-family home community in Phoenix, AZ. These Covenants, Conditions, and Restrictions (CC&Rs) apply to all lot owners and residents, establishing rules for property use, maintenance, and architectural control.
- Residential use & occupancy: All homes must be used exclusively as a single-family residence. A 'Single Family' is defined as a group of related persons by blood, marriage, or adoption, or up to three unrelated persons maintaining a common household.
- Architectural review: Any exterior alteration—including construction, painting, landscaping, or adding structures—requires prior written approval from the Architectural Committee. Approval is deemed granted if no response within 30 days of a complete application. The committee may charge a reasonable review fee.
- Pets & animals: No animals, birds, or livestock are allowed except up to two dogs or cats, plus small household birds. Pets must be leashed (max 6 ft) when off the owner's lot and must not be a nuisance. No pet structures visible from neighboring property.
- Vehicles & parking: Trucks, trailers, campers, boats, and recreational vehicles may not be parked on lots or streets without Architectural Committee approval, except for vehicles stored in garages or in a fenced rear/side yard not visible from neighbors. Motorcycles and similar vehicles may only be parked in garages.
- Signs: No signs visible from neighboring property are allowed except: (i) required legal signs, (ii) approved residence identification signs, (iii) one approved 'For Sale' sign. All require prior written Architectural Committee approval.
- Minimum home size: Each residential unit must have at least 3,700 square feet of livable space under roof, and must be single-story construction not exceeding 24 feet in height.
- Assessments & liens: The Association levies annual and special assessments against each lot. Nonpayment creates a lien on the property and may result in suspension of common area use rights (except ingress/egress).
