What Aliso Canyon's governing documents say
Aliso Canyon is a single-family home subdivision in Phoenix, AZ. These Covenants, Conditions, and Restrictions (CC&Rs) run with the land and bind all lot owners, their tenants and guests. They cover property use, maintenance, architectural controls, and parking rules for a standard HOA community.
- What you can build or change: All construction, fences, walls, or exterior alterations require prior written approval from the Architectural Control Committee. Plans must be submitted; if the committee doesn't respond within 30 days, approval is deemed granted. All changes must also comply with Phoenix zoning and building codes.
- Parking & vehicles: Motor vehicles may only be parked in the garage or driveway. Buses, vans, motor homes, RVs, and trucks with a carrying capacity over 3/4 ton or designed for commercial purposes are prohibited on lots.
- Outdoor equipment & activities: No open fires or burning is allowed (except customary barbecues/grills). Machinery or equipment (except HVAC) must be screened from view. No repair of detached machinery or vehicles may be done within view of neighboring lots or streets.
- Signs & advertising: No exterior signs or advertisements are allowed except for mailboxes, residential nameplates, and 'for sale' or 'for rent' signs that conform to specifications set by the developer (including reasonable size restrictions).
- Lot use & maintenance: Lots cannot be subdivided. No lot may be used in a way that is unsightly (e.g., clothes drying in public view), a nuisance, or endangers health. Owners must prevent disease, noxious insects, and overhanging vegetation onto sidewalks. No oil, gas, or mineral drilling or mining is permitted.
- Party fences: Owners of adjoining lots with a party fence share equal use rights. If damaged by one owner's act, that owner must repair at his own cost. If damaged by ordinary wear, the cost is shared equally among all adjoining owners.
- Enforcement & term: Violations can be enforced by the developer or any lot owner through legal action, with the violator liable for costs and attorneys' fees. These covenants run for 30 years from recording, then auto-renew for successive 10-year periods. They can be amended by a majority of lot owners.
