What Piedmont Tech Center Owners Association, Inc.'s governing documents say
Piedmont Tech Center is a commercial condominium in Phoenix, AZ, with two units (Unit I and Unit II). It is owned in fee simple, with each unit having an undivided interest in common elements (Unit I: 81%, Unit II: 19%). The property is strictly for commercial, industrial, or office use—no residential use allowed. This is the full declaration governing the condominium.
- Property use (commercial only): All units are restricted to commercial, industrial, or office purposes. No residential use is permitted anywhere in the project.
- Parking allocations: Each unit has exclusive use of designated covered parking spaces: Unit I uses spaces 13–55 of Limited Common Area B; Unit II uses spaces 1–13 of Limited Common Area B and the truck parking area (Area A). Additionally, among 187 uncovered common-element parking spaces, Unit I may use up to 155 and Unit II up to 32, on a first-come, first-served basis.
- Architectural review: Any exterior changes, signs, or structural alterations require prior written approval from the Board of Directors (unanimous consent). Plans must be submitted; the board has 30 days to review, with a possible 30-day extension. If no decision within that time, approval is deemed granted.
- Assessments & fees: Annual assessments are based on common expense budgets and apportioned according to each unit’s undivided interest (81% for Unit I, 19% for Unit II). Special assessments require a 51% vote of total votes. Late payments accrue 18% annual interest. The association has a lien for unpaid assessments.
- Special cost allocations: Lobby maintenance costs are split equally (50% to Unit I, 50% to Unit II). Unit II may opt out of paying for casualty insurance and management fees if it obtains its own policy naming the association as insured.
- Maintenance responsibilities: The association maintains all common elements and limited common elements (e.g., roofs, fences, landscaping, parking areas). Each owner must keep their unit in clean, good repair and maintain positive drainage. Owners are also responsible for limited common elements assigned to their unit (e.g., exterior doors, windows, shutters).
- Leasing (commercial): No residential use is allowed, so leases must be for commercial purposes. The declaration does not impose a minimum lease term or restrict leasing beyond requiring compliance with all rules.
- Insurance and casualty: The association carries master insurance. If damage occurs, repair is mandatory if insurance proceeds are sufficient or if less than 75% of the project is destroyed and 80% of owners do not vote to rebuild. For 75% or more destruction, rebuild unless 80% vote not to. Owners may have individual policies.
