This document is the enforcement procedures policy for the North Slopes Homeowners Association, a planned community in Phoenix, AZ. The procedures apply to owners, their family, tenants, and guests.
- Complaint & investigation process: Any member, board member, or association agent can file a written complaint. The association investigates within 10 business days (or immediately for emergencies).
- Friendly reminder: On the first violation in a calendar year, a friendly reminder is mailed to the owner requesting correction.
- Courtesy and fine notice: For repeat or continuing violations, a written notice is sent giving 25 days to correct the violation, after which fines may be imposed.
- Fine notice: If the violation is not corrected (or for egregious cases without a courtesy notice), a fine notice is mailed. Fines are cumulative and continue until the violation is corrected.
- Appeal process: The owner has 10 calendar days from the fine notice to request a hearing before the board. The hearing is held in executive session; the board's decision is final.
- Fine amounts: General violations: $25 initial; $50 after 25 days; $100 every 30 days thereafter. Board may impose up to $2,000 for egregious acts. Architectural violations: $1,000 for unauthorized work, $500 for improvements, $500/month for unfinished new construction. Leasing violations: $2,500 plus $1,000 per day.
- Subsequent violations: For the same violation within the same calendar year, fines are doubled and the courtesy notice step is skipped.
