Bungalows at Orangewood is a standard single-family home HOA in Phoenix, AZ. You own your lot and home; the association maintains the common areas, including private roadways and landscaped tracts. The HOA enforces rules to preserve property values, and all owners must pay assessments.
- What you own & maintain: You own your lot and home outright. You are responsible for all maintenance and repairs on your lot, including lawns, buildings, and any exterior alterations. The association maintains common areas (Tracts A-D, roadways, sidewalks, access gates) and may enter your lot for common-area upkeep.
- Architectural review: Any exterior change (building, fence, paint, landscaping, etc.) must be approved in writing by the Architectural Committee. Plans are deemed approved if no response within 45 days. The committee can reject proposals for aesthetic or harmony reasons. Declarant controlled the committee initially; after Declarant leaves, the Board appoints members.
- Assessments & fees: Annual assessments are levied per lot. The initial maximum annual assessment is set in the declaration (the exact dollar amount is illegible in this copy). The maximum automatically increases each year by the greater of 5% or the CPI change, plus any increase in water/utility/insurance costs. Assessments cannot rise more than 20% year-over-year without a majority vote. Special assessments for capital improvements require 2/3 of each membership class. A late fee (greater of $15 or 10% annual interest) applies after 15 days. A capital reserve fee equal to 1/6 of the current annual assessment is due from the first purchaser of each lot. Transfer fees may also be set by the Board.
- Use restrictions (pets, vehicles, etc.): Pets: only a reasonable number of domestic household pets, no commercial breeding, and no structures visible from neighboring property. Vehicles: no vehicles over 1 ton capacity, no inoperable vehicles, and no boats/trailers/recreational vehicles visible from neighboring property. On-street parking is limited to short-term loading, guest visits (no overnight), or special events. Garages and driveways are the primary parking areas. Signs: only one temporary "for sale" sign (up to 5 sq ft) and a small name/address sign (9"x30") are allowed. Clotheslines must be in a fenced service yard or not visible from neighboring property.
- Leasing & rentals: Leases are allowed but must be for a term of 30 days or longer (no short-term rentals). A copy of the lease must be provided to the association, and the lease must require the tenant to comply with the CC&Rs and HOA rules.
- Dispute resolution: Before any lawsuit, disputes between owners, the association, or Declarant must go through negotiation, then mediation, then arbitration. Excluded are disputes about assessment payment. The exact procedures are detailed in Article X.
