Villas Northern Three is a townhome (attached) community in Phoenix, AZ — you own your individual lot and townhouse unit, but share party walls with neighbors. The association maintains common areas, exterior building surfaces, and provides water, funded by per-unit assessments. This declaration of covenants, conditions, and restrictions (CC&Rs) establishes the governing rules for owners, residents, and the association.
- What you own & maintain: You own your townhouse unit interior and must maintain it, including fixtures and equipment inside the exterior walls. The association maintains roofs, gutters, exterior surfaces, trees, shrubs, walks, and other exterior improvements, but not glass surfaces. Termite control is your responsibility.
- Assessments & fees: All lots pay annual assessments (initially capped at $325 per year) and special assessments for capital improvements. Annual increases up to 3% per year require no vote; increases above 3% need a 2/3 vote of members. Assessments are a lien on the property and personal obligation of the owner. Interest on late payments is 6% per annum.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the board or an architectural committee. Plans and specifications must be submitted; approval is deemed given if no response within 30 days.
- Party walls: Walls constructed on the dividing line between units are party walls. Adjoining owners share repair and maintenance costs proportionally. If damaged by an owner's negligence, that owner bears the full cost. Disputes may be submitted to arbitration.
- Use restrictions: Properties are restricted to residential use only. No business activities, temporary structures, or commercial vehicles are allowed. One 'for sale' or 'for rent' sign (max 5 sq. ft.) per lot is permitted. Clotheslines must be in patio areas and screened from view. No abandoned or inoperable vehicles visible from other lots or streets.
- Parking & vehicles: Each lot is entitled to one assigned parking space near the unit. No abandoned or inoperable vehicles may be stored where visible from neighboring lots or streets.
- Pets: Dogs, cats, or other household pets may be kept, but not raised, bred, or maintained for commercial purposes.
