Northern Lanai is a standard single-family home HOA in Phoenix, AZ. Homeowners own their individual lot and share access to common areas that the association maintains. All owners are automatically members and must pay assessments. The declaration was recorded in 1974, so some provisions (e.g., initial assessment amounts) may be outdated, but the fundamental structure remains.
- Property rights in common area: Every owner has a non-exclusive right to use the common area, but the association can charge fees for recreational facilities, suspend voting/use rights for unpaid assessments, and adopt rules. Owners may delegate use to family, tenants, or contract purchasers who reside on the property.
- Assessments & finances: The association levies annual and special assessments. The initial maximum annual assessment was $102 per lot, with annual increases capped at 3% without a membership vote.
