What Melrose Northern's governing documents say
This is a single-family residential subdivision in Phoenix, AZ, governed by restrictive covenants that run with the land. There is no homeowners association; enforcement is through court action. These rules apply to all lot owners and are automatically renewed every 10 years unless a majority votes to change them.
- What you can build: Only one detached single-family dwelling per lot, with a minimum construction cost of $5,000 (1964 value) and a minimum ground floor area of 1,002 square feet, excluding open porches, pergolas, or attached garages. No house trailers may stay longer than 5 days. No detached garage or outbuilding may be used for residential purposes.
- Setbacks and building placement: Front walls must be between 20 and 65 feet from the front property line. Side walls must be at least 5 feet from the side lot line, but open carports with frame storage rooms attached to a masonry wall may be 3 feet from the side line. If you own adjoining lots, you may build closer to the common lot line by treating them as one lot.
- Fences and hedges: No solid wall or fence over 3.5 feet high within 20 feet of the front lot line. Side or rear fences and walls (other than the building) may be up to 6 feet high. Hedges over 3.5 feet are not allowed within 20 feet of the front lot line.
- Prohibited uses: No livestock or poultry may be kept. No business, store, office, hospital, sanitarium, theatre, saloon, or other place of entertainment may be conducted on any lot. No business of any kind may be operated from a residence.
- Lot subdivision: Lots may not be subdivided into smaller lots unless it is a transfer between adjoining owners, a resubdivision of adjoining lots that maintains or increases the average area and frontage, or a dedication for public utilities. The resulting parcels are then considered as one 'lot' under these restrictions.
- Duration and amendment: These restrictions run with the land and were originally set to expire March 1, 1994, but automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. Violations may be restrained by court action, but a violation does not affect any existing mortgage lien.
