What Northern Village Extension No.'s governing documents say
This is a declaration of restrictive covenants for Northern Village Extension No. Three, a single-family residential subdivision in Phoenix, AZ (Maricopa County). The restrictions run with the land and bind all lot owners, originally through April 1, 1992, with automatic ten-year renewals unless changed by a majority vote of owners. No homeowners association is created; enforcement is by other property owners.
- Single-family use only: All lots are designated as single-family residential lots. No business, store, office, theater, saloon, or care facility may be operated on any lot.
- Minimum dwelling standards: Each dwelling must be new construction (no moved buildings), at least 1,200 square feet of ground floor area (excluding open porches and attached garage), and have a reasonable cost of at least $7,000.
- Setback and building placement: The front wall of any building must be at least 20 feet and no more than 40 feet from the front property line. Side walls must be at least 5 feet from the side lot line. Open carports with frame storage rooms attached to a masonry wall may be as close as 3 feet to the side line.
- Fence and hedge restrictions: No solid wall or fence over 3 feet high may be built closer to the front street line than the front wall of the house (or at least 35 feet if no house exists). Side and rear fences and walls (other than the house wall) may be no more than 6 feet high. Hedges over 3 feet tall are prohibited in the front setback area.
- Prohibited uses and nuisances: No livestock or poultry may be kept. No business of any kind may be conducted in or from any residence. No advertising signs are allowed except 'For Rent', 'For Sale', 'Builder's', and 'Developer's' signs. The premises may not be used in a way that endangers health or unreasonably disturbs other lot owners.
- Sanitary requirements: Residential use requires installation of water flush toilets, with all bathrooms and toilets inside buildings. If sewer is unavailable, septic tanks and cesspools must meet FHA specifications.
