What Stardust Skies's governing documents say
Stardust Skies is a single-family residential subdivision in Phoenix, AZ — you own your lot and house, subject to deed restrictions that run with the land until 1991 and auto-renew every 5 years unless a majority of owners change them. There is no homeowners association mentioned in this document.
- Residential use only: All lots are restricted to single-family residential use. No hospital, hotel, apartment, or other commercial enterprises are allowed. Livestock and fowl are prohibited, though household pets are permitted.
- Minimum dwelling size: Each dwelling house must have a floor area of at least 850 square feet, excluding open porches, pergolas, and attached garages.
- Building setbacks: Buildings must be at least 20 feet from the front lot line, 20 feet from the rear lot line, 10 feet from any side street line, and 5 feet from the side lot line (3 feet for open carports or storage rooms). Detached garages more than 15 feet from the residence may be placed within the rear quarter of the lot with reduced setbacks.
- Fences and hedges: Solid walls or fences taller than 2.5 feet are prohibited in the front setback area. Side and rear fences may be up to 6 feet tall. Hedges taller than 3 feet are not allowed closer than 20 feet to the front lot line.
- No subdivision of lots: Lots cannot be resubdivided or conveyed in less than their full original dimensions, except for public utilities or combining contiguous lots into larger parcels.
- Temporary structures and signs: No temporary buildings, trailers, shacks, or tents are allowed, except during construction. Advertising signs are limited to one "For Sale" or "For Rent" sign per lot, with specific wording restrictions.
- Duration and enforcement: These restrictions run with the land until July 1, 1991, and automatically extend for successive 5-year periods. They can be changed by a majority vote of property owners. Violations may be enforced by any lot owner through legal action, but do not affect existing mortgage liens.
