The Heritage at Alta Vista is a single-family home subdivision in Phoenix, AZ, governed by a homeowners' association (HOA). This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners, residents, and their guests. It sets rules about property use, appearance, and maintenance to protect property values.
- Residential use & leasing: Lots are for single-family residential use only. Leases must be for at least 30 days, and no transient or hotel use is allowed. A copy of each lease must be provided to the HOA.
- Minimum square footage: Each residence must have at least 1,500 square feet of livable floor area.
- Architectural review: Any exterior alteration (painting, additions, changes to color, roofing, windows, etc.) must be approved in writing by the Architectural Committee before work begins. A deposit up to $2,000 may be required. Unapproved construction can result in a $1,000 penalty.
- Pets: Only customary household pets (dogs, cats, birds) are allowed. They must not create a nuisance, and waste must be disposed of promptly. The HOA board can limit the number of pets if they cause problems.
- Parking & vehicles: No commercial trucks, RVs, boats, or trailers may be parked in view from neighboring property without HOA approval. Inoperable or abandoned vehicles are prohibited. Motorcycles and off-road vehicles must be parked in garages. Street parking is limited to 48 hours. Vehicles violating rules may be towed.
- Landscaping & maintenance: Owners must keep their lots and adjacent rights-of-way landscaped and free of weeds. A minimum front yard landscape (two 15-gallon trees and five 5-gallon plants) must be installed within 60 days of closing. Failure can result in fines and a lien. No rocks of white, green, or red are allowed.
- Fences & walls: Fences must be cement block (unless otherwise approved) and no taller than 6 feet. Party walls (fences on lot lines) are jointly maintained by adjoining owners. Fence color and style must match the developer's original scheme unless changed with HOA approval.
- Assessments & HOA powers: The HOA may levy annual and special assessments to cover common expenses. Non-payment can lead to liens, suspension of common area use, and enforcement through fines. The HOA also has a right to enter lots for inspections or emergency repairs.
