• Location and installation rules: Antennas must not encroach on common area or another owner's property. If possible, they must be placed inside the dwelling for acceptable signal quality. If outside, they must be shielded from view from street and neighbors to the maximum extent. Visible wiring and masts must be painted to match the structure. No antenna may come into contact with power lines, must be properly grounded, and must not block driver's view of intersections or streets. Masts extending more than 12 feet above the roofline require prior Association approval, including a detailed description and necessity explanation.
• Maintenance and liability: The owner is responsible for all installation and maintenance costs, all damage caused by the antenna, and must indemnify the Association for injuries. The antenna must be kept in good repair.
• Notification requirement: Within five business days after installing an allowed antenna, the owner must submit a completed notification form (Exhibit A) to the Association. The owner must also be available to meet with an Association representative at a mutually convenient time if requested.
• Enforcement and fines: For violations, the Association may seek declaratory relief from the FCC or Maricopa County Superior Court. If the rule is enforceable, the owner pays a $50.00 fine per violation, plus $10.00 per day for continuing violations. The Association can also seek injunctive relief for immediate safety hazards and recover reasonable attorney's fees.
