This is the First Amendment (1974) to Orangeaire Villas' original 1973 Declaration of Covenants, Conditions and Restrictions—a lot-based planned community in Phoenix, Arizona. This amendment modifies specific governance sections and is NOT a complete rulebook; refer to the original 1973 Declaration for full community rules.
- Developer control & voting transition: The Declarant (developer) initially holds Class B voting rights (3 votes per Lot), giving disproportionate control. Class B membership converts to standard Class A (1 vote per Lot) when Class A votes equal Class B votes, by January 1, 1980, or when voluntarily relinquished—whichever is earliest.
- Assessment caps & annual increases: Initial maximum assessment is $432 per Lot annually. After the first Lot is sold, assessments can increase up to 3% yearly without a member vote; increases above 3% require a two-thirds vote from both voting classes.
- Developer Lot exemptions: Lots owned by the Declarant are exempt from assessments, except if occupied under lease or rental (then fully assessed). Once the Declarant's voting class converts to Class A, remaining Declarant Lots pay at half the rate of other Lots.
- What this amendment doesn't include: This document modifies only specific sections of the original Declaration. Refer to the 1973 original for use restrictions, pet policies, architectural review, leasing rules, parking, and other governance.
