You own your individual unit and an undivided share of the common elements; the association maintains the common areas and carries master insurance. This document, the Amended and Restated Declaration, sets the full rules for owners, tenants, and occupants.
- What you own & maintain: You own your unit's interior to the unfinished surfaces of walls, floor, and ceiling. The association maintains all common elements, including roofs, exterior walls, and common areas. Limited common elements such as patios, carports, and storage sheds are assigned to your unit for exclusive use, but you are responsible for their upkeep (e.g., interior of patio).
- Leasing & rentals: Leases must be in writing for a term of at least 30 days. No subleasing or assignment is allowed. You must provide the association with a copy of the lease, tenant names, and emergency contact at least 10 days before the lease starts. You remain liable for your tenant's compliance with all rules.
- Pets: You may keep up to two domestic pets (dogs, cats, fish, or small birds) per unit. Dogs and cats cannot exceed 40 pounds each. Pets must be leashed on common elements and waste must be cleaned up immediately. The board may ban breeds with a propensity to attack or that become a nuisance; such pets must be removed within 5 days of a written demand.
- Parking & vehicles: Only authorized vehicles (passenger cars, SUVs, passenger vans up to 10 people, motorcycles, and pickup trucks under 1 ton rating, max 7 feet tall) may be parked on the property. Each unit has designated carport spaces for parking only; no storage, repairs, or maintenance in carports. Vehicles violating rules may be towed at owner's expense.
- Alterations & improvements: No exterior changes (including window coverings, antennas, signs, or patio items) without prior written board approval. Interior alterations that could affect structure or systems also require approval. The board may require plans, security deposits, and licensed contractors. Work must comply with all codes and not create nuisances.
- Use restrictions: Units are for residential use only. Home businesses are allowed only if not visible or audible from outside, involve no customer visits, and are consistent with residential character. No nuisances, hazardous materials, or excessive noise. Hard floor coverings must have sound underlayment. No water beds or aquariums over 30 gallons.
- Assessments & fees: The association levies regular assessments based on unit square footage, plus special assessments, individual expense assessments, and enforcement assessments. Assessments are due as stated in the budget; nonpayment results in a lien and collection costs. A transfer fee may be due upon sale.
