What Orangewood Farms's governing documents say
This is an amendment to the Declaration of Restrictions for Orangewood Farms, a single-family subdivision HOA in Maricopa County, Arizona (Lots 1-48). It modifies only the assessment calculation and enforcement penalties; it does not restate the full rules of the community.
- Assessment structure (irrigation usage): Assessments are split based on whether a lot uses the irrigation facilities. 'Using' members pay a share equal to 120 times a base rate; 'non-using' members pay 100 times the base rate. A member who uses irrigation at least once in a year is considered a using member beginning with the next billing period. The board may add a 5% yearly increase and levy emergency assessments.
- Reserve fund: The board may assess up to 20% of regular assessments per year for emergency repairs and improvements, but the reserve fund cannot exceed one year's estimated expenses.
- Late payment & interest: Unpaid invoices accrue interest at 18% per annum after 30 days. After 90 days nonpayment, the board may suspend the member's privileges until all owed amounts are paid.
