Palmaire Court is a single-family home subdivision in Phoenix, AZ, created by Habitat for Humanity Central Arizona. You own your lot and home; the association maintains common areas and enforces rules. Special leasing restrictions apply due to Habitat’s loan programs.
- Leasing & rentals: Leasing is prohibited if the owner has a Habitat loan. Otherwise, leases must be for at least one year, and the owner must provide the tenant with a copy of this declaration. The owner remains responsible for all rule compliance during the lease.
- Pets: Only dogs or cats for domestic purposes are allowed, with a maximum of two per lot. 'Vicious animals' are prohibited, defined as pit bulls, Rottweilers, or any animal with a propensity to endanger humans.
- Parking & vehicles: No vehicles over ¾ ton, recreational vehicles, boats, or trailers may be parked or stored on lots or streets. Pickup trucks under ¾ ton used for basic transportation are allowed. Inoperable vehicles and extensive repairs are prohibited except for short-term emergency repairs.
- Architectural review: All exterior changes must be approved by the Board per the Design Guidelines. Repainting original colors or rebuilding to original plans is exempt. The Board must respond in writing; failure to respond means denial. Approval expires if construction hasn't started within 120 days.
- Assessments & fees: All owners pay monthly assessments to fund common expenses. Annual increases are capped at 20% without a membership vote. Special assessments may be levied. Delinquent assessments become a lien against the lot.
- Maintenance responsibilities: The association maintains common areas, and may also maintain roofs, paint, and streets. Owners maintain their lot, residence, and improvements. Shared exterior fences are jointly maintained by adjoining owners; costs for fence repair not covered by insurance are shared equally.
- Use restrictions: Lots are for single-family residential use only. No business, commercial, or nonresidential use allowed. No temporary structures or vehicles may be used as residences. Outside clotheslines, antennas, and satellite dishes must be screened. Signs are limited to required, identification, construction, or for-sale/rent signs. Trash must be kept in covered containers and not visible except during collection. A mandatory recycling program may be established by the Board.
