Properties may be used for commercial offices, residential dwellings, hotels, or retail businesses. Owners (which include fee title holders and long-term lessees) are automatically members of the Phoenix Gateway East Property Owners' Association, which maintains common areas, levies assessments, and enforces the rules. This document was recorded in 1988 and runs for 50 years, with automatic 5-year extensions unless terminated.
- Permitted uses: Property may only be used for commercial and professional business offices, residential dwelling units, hotels, or retail businesses, and must comply with Phoenix City Code zoning. Declarant must approve any other proposed use.
- Architectural review & design standards: All improvements require Declarant's prior written approval of plans and specifications. Approval is at Declarant's sole discretion based on conformity, design, and harmony with neighboring structures. A fee of $250 (if architect-designed) or $500 (otherwise) is paid at submission. Overhangs, signs, and other features may require separate approval.
- Setbacks & building coverage: Maximum building coverage is 50% per lot. Minimum setbacks: 40 feet from front property line, 30 feet from side and rear. Exceptions for steps, walks, low planters (max 3 ft height), and certain roof overhangs with approval.
- Parking: Each lot must maintain adequate parking for employees, customers, and visitors without using adjacent streets. Parking is not permitted within the setback areas.
- Signs: No signs without written Declarant approval. Permitted only for identifying the occupant's name, business, and products, and for sale/lease signs (with approval). Size, design, material, and color are subject to approval.
- Assessments & fees: The Association levies regular and special assessments, payable quarterly or as determined by the Board. Special assessments exceeding 25% of budgeted gross expenses require 51% member approval. Delinquent payments incur a $25 late charge plus interest at 5% above Prime Rate. Unpaid assessments create a lien against the lot (subordinate to first mortgages).
- Common areas & association: The Association is responsible for operating, maintaining, and insuring common areas (Tract A and any designated areas). Declarant initially controls the Association (Class B membership with 5 votes per square foot) until Class A members (other owners) exceed Class B votes or 25 years pass, whichever comes first. The Association has the power to enforce rules, levy assessments, and enter lots for inspections/remedial work.
- Term & amendments: The Declaration runs for 50 years from recording (1988) with automatic 5-year renewals. It can be terminated or amended with written consent of 60% of owners (by square footage), plus Declarant's approval if it still owns at least 5% of the net square footage.
