Saguaro Condominium Group is a condominium community in Phoenix, AZ. This document is an amendment to the community's declaration that adds restrictions on leasing and prohibits timesharing arrangements. It does not contain the full set of community rules.
- Leasing & rentals: Rental of lots is generally prohibited, but owners who were renting when the amendment was recorded may continue until the lot is sold. The board may grant hardship exceptions for up to 12 months. All leases must be in writing for a term of at least 6 months and include a Crime Free Lease Addendum. Owners must submit a rental registration form for each new tenant or lease, and the board may impose fines for non-compliance.
- Timesharing: No lot may be used under any timesharing plan, fractional ownership, or similar arrangement allowing use by three or more unrelated persons during any 365-day period.
- Owner responsibility for tenants: Owners remain liable for compliance by their tenants, family, and guests. Owners must provide a copy of the governing documents to each tenant. Any violation of the documents is a default under the lease and grounds for eviction.
- Enforcement: The board may adopt a schedule of fines for violations and may require an owner to evict a tenant who violates the documents; if the owner fails to evict, the board may impose penalties and pursue other remedies.
- What this document doesn't cover: This is a partial amendment. It does not address assessments, maintenance responsibilities, age restrictions (despite the Sun City location), pet limits, parking, or architectural standards. Those rules are found in the original Declaration and other governing documents.
