This document is the master declaration of restrictions binding all lot owners and their successors.
- What you own & maintain: You own your single-family home and lot; the association maintains common areas and grounds. You must keep your home in good condition and repair, and landscaping must be installed within 90 days of purchase. The association can enter your property to plant or maintain landscaping in common-area easements.
- HOA assessments & fees: Annual assessments start at $282.60 per lot (through 1995) and can increase yearly by the greater of 10% or the Consumer Price Index without a vote; larger increases require a 2/3 member vote. Late payments incur a $10 charge plus 12% annual interest. The association can place a lien on your home for unpaid assessments and foreclose to collect.
- Architectural review & exterior changes: Any exterior alteration—additions, painting, repairs, landscaping changes, fences, antennas—requires prior written approval from the Architectural Committee. The committee has 45 days to approve or deny; if no decision is made, approval is deemed given. All utility lines must be underground or concealed. Failure to maintain the exterior can result in the association making repairs at your expense.
- Single-family use only: Only one single-family residence and private garage may be built per lot; no commercial use, rental apartments, or multi-unit conversions are allowed. Short-term leasing to a single family is permitted, but the property cannot be subdivided or converted to a condominium without board approval.
- Parking & vehicles: No trucks larger than 3/4 ton, motor homes, boats, trailers, RVs, or commercial vehicles may be parked or stored visibly from neighboring property or streets. Pickup trucks under 3/4 ton and mini-motor homes (≤7 ft. tall, ≤18 ft. long) can be stored only in screened areas with committee approval. Garages must be used for vehicle parking only.
- Pets & animals: Only a reasonable number of generally recognized house or yard pets are allowed; the board has sole discretion to determine what qualifies and whether an animal constitutes a nuisance. No commercial breeding, and animals cannot make unreasonable noise or be visible from neighboring property.
- Party walls: If your lot shares a party wall or fence with an adjoining lot, both owners have equal rights to use it—provided one owner's use doesn't interfere with the other's. If a party wall is damaged by your action or a guest's, you must rebuild it at your own cost.
- Voting rights & membership: As a homeowner (Class A member), you hold one vote per lot. The developer (Class B) initially held three votes per lot but this converts to Class A voting once homes are sold or by the end of 2009.
