South Mountain Plaza is a commercial shopping center in Phoenix, AZ. This declaration creates a system of covenants, conditions, restrictions, and reciprocal easements that bind all owners of parcels within the shopping center. It governs how the property is used, maintained, and operated, and applies primarily to commercial property owners and their tenants, not residential homeowners.
- Uses & restrictions: Permitted uses include retail sales and services and other related commercial uses. Prohibited uses include nuisances, warehouses, mobile home parks, junkyards, auto sales (except from indoors), hotels, animal raising (except pet stores/vets), massage parlors (except day spas), pornographic stores, head shops, gambling, funeral homes, and any use violating zoning. Certain exclusive use rights may be granted to specific occupants.
- Common Area maintenance & costs: The Declarant (developer) is responsible for maintaining common areas (parking, landscaping, lighting, utilities, etc.) and recovers costs from owners/occupants based on their proportionate share of land area. A 15% management fee is added. Owners/occupants pay monthly estimates, with annual reconciliation and audit rights. Delinquent amounts become a lien on the parcel.
- Construction & alterations: All construction must be within designated building areas and comply with architectural theme approved by Declarant. Detailed plans must be submitted for approval. Buildings must have sprinkler systems unless free-standing. Construction must minimize interference with other owners and comply with laws. Temporary licenses for access during construction are granted.
- Easements & access: Non-exclusive easements are established for ingress/egress, parking, utilities, construction, and drainage. Owners have the right to use common areas for parking (no overnight except late-shift employees), pedestrian traffic, and temporary construction staging. The Declarant may close areas for repairs or to prevent prescriptive rights.
- Insurance & damage: Owners must maintain insurance for their buildings and indemnify others. Common area insurance is carried by Declarant. If a building is damaged by casualty, the owner must remove debris and within 90 days elect to repair, rebuild, or (with Declarant's consent) pave/landscape the building area until later rebuild.
- Signage & lighting: Declarant controls common area lighting and monument/pylon signs. Owners must submit sign plans for approval. Excess lighting costs may be charged to specific occupants. All signage must comply with applicable law and Declarant's criteria.
