What St. Croix Villas Condominiums's governing documents say
St. Croix Villas is a 10-unit condominium community in Phoenix, AZ (established 1988) — you own your unit's interior and share ownership of the building structure and common grounds through the homeowners association, which maintains and insures everything funded by regular per-unit assessments.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings as finished surfaces). The association owns and maintains the roof, structural walls, foundations, exterior, shared utilities, parking areas, landscaping, and any common recreational facilities like the pool.
- Assessment limits & payment terms: Initial assessment capped at $900/year per unit; annual increases limited to the greater of 5% or the prior year's CPI change, unless owners approve a higher increase by 2/3 vote. If payment is late (beyond 10 days), you owe a 10% late charge plus interest at ~18% annually (Arizona Bank prime rate + 4%, minimum 18%), plus attorneys' fees and collection costs if the association sues. The association can lien your unit to enforce collection.
- Use & occupancy restrictions: Units are for residential use only and must comply with all laws and insurance requirements. Prohibited or restricted items include boats, motor vehicles (in or near units), signs, windbells, air conditioners and antennas (likely requiring approval), excessive trash, clotheslines, and hazardous conditions. The community also restricts vegetation and nuisances; specific rules on pets and parking are in the Board's association rules.
- Association governance & voting: The Board of Directors governs the community. Initially (until 75% of units are sold to non-developer owners, or 4–6 years after first sale), the Declarant appoints the Board. After that, owners elect the Board (you get one weighted vote per unit, proportional to your unit's share of common elements, which is 1/10). The Board's decisions are final and binding; the Board can adopt rules on use, conduct, fines, and penalties.
- Insurance & damage restoration: The association carries master insurance on the common elements and building. In case of major damage or destruction, the Board decides whether to restore or terminate the condominium; restoration costs are funded via special assessments and insurance proceeds. First mortgagees have rights to notice and approval of insurance handling.
- Architectural review & landscaping: Alterations, additions, and landscaping changes are subject to architectural control by the Board per the declaration and association rules. The Board sets design and maintenance standards; the Board may designate certain common elements (e.g., window screens, patios, storage areas) as Limited Common Elements to be maintained by individual owners at their expense.
