This document is the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for The Townhomes at Roosevelt Square One, a townhome community in Phoenix, AZ. It is not a condominium—each owner owns their lot and home, and the HOA manages common areas and exterior maintenance. The rules apply to all owners, residents, and their guests.
- Maintenance responsibilities: You maintain the interior of your unit. The HOA is responsible for exterior surfaces (walls, roof, windows, doors), foundation, front-yard landscaping, sidewalks, driveways, and irrigation serving front yards.
- Leasing & rentals: Leases must be in writing for a term of at least 12 months, require tenants to comply with governing documents, and be reported to the board within 10 days. Subleasing and assignments require board approval.
- Architectural review: Any exterior changes to your unit or landscaping require prior written approval. For the first 15 years, the reviewer is Post Apartment Homes, L.P.; afterward, it's the HOA board. Decisions may be based purely on aesthetics.
- Home business use: Units may be used for certain professional businesses (e.g., law, accounting, real estate, medical, dental) if the owner/occupant lives there, no more than 5 people in the unit at once, and the business is not detectable from outside. Restaurants, adult entertainment, and commercial lodging are prohibited.
- Assessments & fees: All owners pay annual assessments to fund common expenses. The HOA can levy general, special, and specific assessments. Delinquent assessments accrue 18% annual interest and late charges, and become a lien on the property.
- Insurance: The HOA carries property insurance on all units (excluding owner-added improvements) and general liability insurance. Owners are responsible for insuring their own belongings and additional improvements.
