The Fontenelle Lofts Condominium is a 7-unit condominium in Phoenix, AZ. You own your unit and share ownership of common elements with other owners. The association maintains the building exteriors, roofs, parking areas, landscaping, and other common areas. Unit owners are responsible for maintaining their interior, limited common elements (like gardens, balconies, decks, and garages), windows, doors, and mechanical systems.
- Leasing & rentals: Leases must be in writing, for at least 90 days, and cover the entire unit. Unit owners must provide the association with a copy of the lease and tenant information at least 10 days before occupancy. The unit owner is liable for any violations by tenants or their guests.
- Pets: Only one dog per unit is allowed, and it cannot exceed 40 pounds. Other household pets are permitted in reasonable numbers, but no commercial breeding. Dogs must be on a leash no longer than 6 feet when outside the unit. Pets may not be left unattended on common areas, and owners must clean up after them.
- What you own & maintain: You own the interior of your unit including finished surfaces. Limited common elements (e.g., gardens, balconies, decks, garages, tandem parking spaces) are for your exclusive use but you must maintain them, including painting, landscaping, and repairs. The association maintains all common elements (building exteriors, roofs, parking areas, landscaping, etc.).
- Parking & vehicles: Vehicles must be parked only in the assigned garage and tandem parking space. No commercial vehicles, boats, trailers, or inoperable vehicles allowed. Emergency repairs only; no storage of inoperable vehicles for more than 2 weeks. The board may tow violators at owner's expense.
- Modifications & alterations: Any structural modification or change visible from the exterior requires board approval. Nonstructural interior changes that don't affect mechanical systems may be done without approval, but the owner is responsible for any damage. Approval requires plans, indemnity, and a building permit if needed. The board may require a security deposit.
- Home businesses: No business may be conducted that is visible, audible, or noticeable from outside the unit. Only one non-resident employee is allowed. No customers coming to the unit regularly. The leasing of a unit is not considered a business.
- Use restrictions: All units must be used as single-family residences. No time-sharing or short-term rentals. No signs, antennas, or satellite dishes visible from outside without approval (FCC-compliant dishes under 1 meter may be permitted). No nuisances, loud noises, or hazardous materials. Window coverings must not be reflective or otherwise visible from exterior.
