What Sunnyside Tract's governing documents say
Sunnyside Tract is a planned community in Phoenix, AZ, consisting of 23 units in five fourplex buildings and one triplex on six lots. This 1981 Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes an association (the Roosevelt Architectural Control Committee) and sets rules for ownership, maintenance, fees, and governance. The rules bind all lot owners and their tenants.
- What you own & maintain: You own your lot and the building on it. You must maintain the interior, exterior (including paint and roof), any fences, and any part of the lot enclosed by a wall or fence. The association maintains all other common areas and sets architectural standards for your maintenance work.
- Assessments & fees: Owners pay a regular monthly assessment, initially $80 per lot. The board can increase it up to 20% per year without a vote; larger increases require a majority vote of owners (excluding the developer). Special assessments for deficiencies or emergencies are allowed but those exceeding 5% of the annual budget need owner approval. Assessments are a personal obligation and a lien on the lot if unpaid, with interest at 7% per year and collection costs including attorney fees.
- Architectural review: The association (through its board) establishes architectural standards that govern the maintenance and appearance of your property, including painting, fencing, and other exterior elements. If you fail to maintain to those standards, the association may do the work and charge you via a special assessment.
- Association governance: The association is governed by a three-member board elected by lot owners (one vote per lot). Initial directors were named by the developer. Meetings require a 51% quorum; decisions pass by a majority vote, except amendments (which need 75% owner and first mortgagee approval). The board must provide financial statements within set timeframes and hire a professional manager.
- Enforcement & liens: If you violate the CC&Rs, the association can enter your property to correct the issue (after 3 days' notice) and charge you. Unpaid assessments become a lien that can be foreclosed upon. The lien is subordinate to first mortgages. Owners waive homestead exemptions for assessment liens.
- Term of restrictions: These covenants run with the land until January 1, 2000, and then automatically extend for successive 10-year periods unless terminated by a recorded instrument signed by the required percentage of owners.
