What Superblock 6 Desert Ridge's governing documents say
This document is the master declaration for Superblock 6, part of the Desert Ridge master-planned community in Phoenix, AZ. It governs a 410-acre mixed-use development including commercial, industrial, and residential (apartment/condo) uses. The rules bind property owners, developers, and the association. The community is deannexed from the larger Desert Ridge master association but retains certain reserved rights for the master developer and declarant.
- Permitted & prohibited uses: Residential uses are limited to apartment or condominium developments with at least 50 dwelling units. Heavy industrial uses are prohibited. Manufacturing, research, medical labs, warehouse, and office uses are allowed subject to restrictions. Retail, restaurants, hotels, and offices beyond incidental uses require master developer and declarant approval until 2024.
- Design control: All construction, landscaping, and exterior alterations must comply with Design Guidelines enforced by a Design Review Committee appointed initially by the master developer. Plans must be submitted for approval; the committee has 20 business days to object. Variances may be granted, and decisions can be appealed to the board or to binding arbitration.
- Assessments & liens: The association levies annual assessments, special assessments, and maintenance assessments on parcel owners. Unpaid assessments create a lien on the parcel. The association can enforce payment and collect collection costs and interest.
- Common areas & easements: Common areas include arterial common areas (landscaping, sidewalks, trails), wash corridors, and other areas the association maintains. Owners and occupants have nonexclusive easements to use common areas, subject to association rules. Easements are also reserved for landscape maintenance and drainage.
- Association structure & subsidiary associations: The Superblock 6 Property Owners Association is an umbrella organization responsible for common area maintenance, design review, and oversight of any subsidiary associations. Subsidiary associations may be formed for individual parcels, but their governing documents must be subordinate to this declaration.
- Reserved rights of master developer & declarant: The master developer retains approval rights over amendments, certain uses, and termination of the declaration until 2024. The master association retains rights to maintain wash corridors and arterial common areas if the association fails to do so within 90 days of notice.
