Trellis at Colter is a planned community of 20 townhome-style dwelling units in four buildings in Phoenix, AZ. It is a standard homeowner association (HOA) governed by recorded CC&Rs that apply to all owners and residents. The association maintains common areas and enforces rules to protect property values.
- What you own & maintain: You own your lot and the dwelling unit on it. The association is responsible for common area maintenance and certain boundary/perimeter walls, but owners maintain their own lots and structures, subject to architectural guidelines.
- Leasing & rentals: No leases under 30 consecutive days; vacation rentals and timeshares are prohibited. No more than 25% of the 20 lots (i.e., 4 lots) may be leased at any time, with a waiting list if needed. Owners must provide tenant info to the association at least 10 days before lease start, and the association may charge an administrative fee of $25 or as allowed by law.
- Architectural review: Any exterior alteration (including landscaping) that is visible from neighboring property requires prior written approval from the board or an architectural committee. The board has 30 days to respond; failure to act is deemed disapproval.
- Assessments & fees: All lots pay uniform annual assessments, which may not increase more than 20% over the previous year without majority owner vote. Special assessments require a 2/3 vote. The association may levy individual benefitted assessment for water, sewer, trash, or enforcement costs. Delinquent assessments accrue interest and create a lien on the lot.
- Use restrictions: Lots are for residential use only. Home-based businesses are allowed only if not detectable outside the unit and consistent with residential character. Further subdivision or rezoning requires board approval.
