This is an amendment to the condominium declaration for Tres Hombres Condominiums in Phoenix, AZ. It modifies specific rules about assessments, fees, use of patios and windows, management contracts, and FHA/VA compliance. As an amendment, it does not contain the full set of community rules; the original declaration and bylaws remain in effect where not amended.
- Assessments & Fee Caps: The annual assessment per unit was initially capped at $640, and annual increases are limited to the greater of 10% of the prior year's assessment or the CPI increase. Decreases cannot exceed 20% below the previous year's assessment. Special assessments require a 2/3 vote of each membership class.
- Late Payments & Liens: A $15 late fee applies if an assessment is not paid within 10 days of the due date. Unpaid amounts accrue interest at 12% per annum from the due date. The Association may suspend voting rights and common area use for delinquent owners.
- Use of Patios, Balconies, and Windows: No clothing, laundry, or personal items may be hung on patios, carports, balconies, or entry courts. Foil or darkening screens are not allowed on windows, and patios, carports, balconies, and entry courts may not be used for storage.
- Management Contracts: Contracts with the Declarant or affiliates for professional management must allow either party to terminate without cause on 90 days' notice or for cause on 30 days' notice, with no termination fee. The contract term must be reasonable (1–3 years) and renewable only by mutual consent.
- FHA/VA Compliance: The Declarant has the power to amend project documents as needed to comply with FHA, VA, FHLMC, and FNMA requirements, including entering agreements with those agencies. Certain major actions (merger, annexation, dedication of common area, amendment, withdrawal) require prior FHA/VA approval if those agencies have approved the project.
