What Yale Court's governing documents say
Yale Court is a single-family home HOA in Phoenix, AZ. This document binds all lot owners, residents, and tenants to a set of covenants, conditions, and restrictions. The association manages common areas and enforces rules, funded by annual assessments that can increase up to 10% per year or by the CPI, whichever is greater. Initial maximum annual assessment is $1,800 per lot.
- What you own & maintain: You own your lot and the residence on it, including front and side yards. The association maintains designated 'Areas of Association Responsibility' (common areas, perimeter walls, certain easements). You must landscape your front yard within 30 days of purchase and maintain all landscaping; dead plants must be replaced promptly.
- Assessments & fees: Annual assessments start at $1,800 per lot and can increase annually by up to 10% or the CPI increase, whichever is greater. Larger increases require a majority member vote. The association may also levy special assessments with a majority vote. A transfer fee (amount set by board) is due from each purchaser upon buying a lot.
- Leasing & rentals: Owners may lease their lots, and tenants have the right to use common areas. The document does not specify a minimum lease term. Lessees must comply with all governing documents; violations by tenants can result in fines against the owner.
- Architectural & maintenance standards: The board sets maintenance standards and may adopt rules for lot upkeep. - Insurance: The association must carry at least $1,000,000 general liability insurance and property insurance on common areas at full replacement cost. Owners are not personally liable for damage to common areas unless caused by their negligence.
