Casa Tomas is a townhouse community in Phoenix, AZ where you own an individual unit (sub-lot) with shared party walls, and the association maintains exteriors, roofs, carports, and common areas. A critical restriction for new buyers: rentals are prohibited — only owners who held their unit before January 4, 2014 can rent, and that right ends permanently if they sell.
- What you own & maintain: You own your unit's interior, windows, doors, garage doors, gutters, and courtyard enclosures. The association maintains all exterior walls and trim, roofs, carports, common areas, landscaping, streets, parking areas, sidewalks, the perimeter brick wall, and swimming pool.
- Leasing & rentals: New owners cannot rent their units — only those who owned as of January 4, 2014 may rent, and that privilege ends permanently if they sell. This makes Casa Tomas owner-occupied only for all future buyers.
- Assessments: Each owner pays 1/31 of total costs (taxes, maintenance, insurance, reserves, recreational facilities), billed monthly. Annual increases are capped at 20% without majority approval; larger increases require 51% member written consent. Unpaid assessments accrue 6% annual interest and become a lien on your unit.

Home-based business permitted only if not visible, audible, or noticeable from outside, and doesn't cause parking or nuisance problems. - Party walls & shared responsibility: Walls between units are jointly owned. If one owner's act damages the wall, that owner repairs at full cost; for other damage (natural wear), both owners split costs equally. Modifications affecting party walls require adjoining owner's written consent.
- Voting & membership: Each owner gets one vote per unit. Voting rights are suspended if you're 15+ days late on assessments or in default of other Declaration rules.
