Velda Rose Gardens-Countryside is a 55+ active-adult property owners association (HOA) for single-family lot owners in Phoenix, AZ. This document is the association's bylaws, which govern membership, meetings, elections, assessments, and age restrictions. It applies to individual/family lot owners only—developers and companies cannot hold membership.
- Membership & voting: Membership is limited to individual or family lot owners; developers or companies cannot be members. Each membership gets one vote regardless of the number of lots owned. Voting may be in person or by absentee ballot; proxy voting is not permitted. Members must be current on dues to vote or hold office.
- Board of Directors: The Board consists of 11 members: 6 Directors, 4 Officers (President, VP, Secretary, Treasurer), and a Social Chairperson. All serve without compensation. Board members must have been property owners for at least 6 months. The Board cannot spend over $1,500 on any single item (other than utilities and operational expenses) without a membership vote.
- Meetings: Annual General Meeting is the third Monday in January at 7:30 PM at the Club House. Two additional membership meetings are held in March and November. Special meetings can be called by 4 Board members or a petition by 30 members. Board meetings are open to members; each member can speak up to 5 minutes (30-minute total limit).
- Dues & assessments: Monthly assessments are due on the 1st and overdue by the 10th. A late charge is set by the Board. If an account is 3 months in arrears, the full balance becomes due. After 6 months, the account is sent to collection, and the member pays all costs including attorney fees. Changing the monthly assessment requires a majority vote at the Annual General Meeting.
- Age restriction (55+): At least one occupant of each dwelling unit must be 55 years or older. No person under 18 may occupy a unit for more than 90 days in any 12-month period. This does not apply to units occupied before September 12, 1988. If the qualifying occupant dies, remaining occupants may continue living there. The Board may conduct surveys to verify compliance.
- Amendments: Proposed bylaw amendments are reviewed by a By-Laws Committee and posted on the Club House bulletin board at least 14 days before the Annual General Meeting. Adoption requires a two-thirds vote of members present at that meeting. Amendments cannot conflict with the community's Articles of Incorporation, applicable law, or deed restrictions.
