This is an amendment to the governing documents for Vista Villa Town Homes, a townhome community in Phoenix, AZ, enacted in 1998. It is a partial document—an amendment rather than a full rulebook—that establishes the phased development plan, creates an Architectural Review Committee, and clarifies the Association's exterior maintenance duties. This amendment does not replace or fully summarize the original Declaration.
- Phased development: The community will be developed in multiple phases as designated by the Declarant. Each unit has one vote and an equal share of common expenses, calculated as 1 divided by the total number of units in the development. The Declarant may alter the sequence of phases.
- Architectural review: No exterior work—including modifications, alterations, additions, color changes, fences, walls, landscaping, or grade changes—may be done without prior written approval from an Architectural Committee of at least three members. Approval requests must be submitted in writing; if the Committee does not respond within 30 days, approval is automatic. No deviations from approved plans are allowed without further written approval.
- Association maintenance responsibilities: The Association is responsible for maintaining, cleaning, painting, repairing, and providing general care of the exterior of all residential units, including roofs, keeping them in good condition and attractive state consistent with community standards.
- Phase withdrawal: Individual phases can be withdrawn before any units are sold to owners. After units have been conveyed to owners, withdrawal requires written consent of 75% of all unit owners and all first mortgagees or fee owners under contracts of sale.
- What this document doesn't cover: This is an amendment to an original 1996 Declaration; it addresses only phased development, architectural review, maintenance, and phase withdrawal.
