What Wescott Commons's governing documents say
Wescott Commons is a single-family home subdivision in Phoenix, AZ (Maricopa County). These covenants, conditions, and restrictions (CC&Rs) apply to all lot owners and residents, setting rules for residential use, construction, maintenance, and property appearance. The document runs with the land and is enforced by the Declarant or any lot owner.
- Residential use & home occupations: Lots are exclusively for residential use. Home occupations are allowed only if entirely inside the dwelling, incidental to residential use, no employees except domestic help, no product sales, no outdoor storage, and no signs beyond allowed identification signs.
- Lot & building requirements: Minimum lot size is 6,000 sq ft (no subdivision below 9,000 sq ft). Dwellings must be at least 1,300 sq ft of livable floor area (excluding garage, porches, patios, breezeways), no more than two stories or 32 feet tall. Construction materials: masonry, frame stucco (painted) or natural stone; roofing must be concrete or clay tile. New construction only. Setbacks: 18 ft front, 10 ft side street, 3 ft side property line, 25 ft rear. Construction must be completed within 12 months.
- Parking & vehicles: Each lot must have an enclosed garage with space for at least two vehicles. No street parking. Vehicles must be kept in garage or on driveway. No junk or inoperable vehicles, boats, or equipment visible from neighboring lots. No motor vehicle repair visible from neighbors (except emergency repairs).
- Pets & animals: Only a reasonable number of common house or yard pets allowed, kept as domestic pets only (no commercial breeding). No animals causing unreasonable noise or nuisance.
- Leasing (rentals): An owner may lease only the entire lot (no partial leases). Leases must be in writing and subject to the Declaration; lessee noncompliance is a lease default. No minimum lease term specified.
- Signs & antennas: No outdoor antennas or satellite dishes except certain small satellite dishes in backyard not visible from neighbors. Signs limited to: one residential ID sign (max 36 sq in), one 'for sale' or 'for rent' sign per lot. No other signs (commercial, political, etc.).
- Other restrictions: No temporary occupancy (trailers, mobile homes, tents, etc.). No nuisances (odor, debris, noise). Reflective window coverings prohibited. Roof-mounted mechanical equipment not allowed; HVAC and solar panels must be integrated and not visible. Garages must be kept neat and used only for parking and storage.
- Amendment & duration: The Declaration runs for 20 years from recording (1995) and auto-renews for 10-year periods. Termination requires 90% owner vote. Amendment requires 67% owner vote; Declarant has amendment rights as long as it owns any lot, and can amend unilaterally to meet government or lender requirements.
