Butte Haven is a townhome community (attached homes with party walls) in Prescott, AZ. All lots are subject to a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land, binding current and future owners. The CC&Rs establish an association that maintains common areas and provides exterior maintenance for each unit.
- Architectural review: No exterior structure, addition, or alteration may be made without prior written approval from the association's board or architectural committee, based on harmony of external design and location. Approval or disapproval must be given within 30 days of submission.
- Party walls: Walls built on the dividing line between units are party walls. Each adjoining owner shares the cost of repair unless damage is caused by one owner's act (that owner bears full cost). Disputes go to arbitration.
- What you own & maintain: You own your townhouse interior and individual patio; the association maintains roofs, gutters, exterior surfaces, trees, shrubs, grass, walks, private sewers, and adjacent parkways. Owners are responsible for interior maintenance, pest control, and must not impair easements.
- Pets: Dogs, cats, or other household pets are allowed but may not be kept, bred, or maintained for commercial purposes.
- Parking & vehicles: Each lot is entitled to use one assigned parking space near the unit, with the association assigning spaces.
- Use restrictions: Properties are restricted to residential townhouse use only. No temporary structures, trailers, tents, or business activities are allowed (except builder's office/construction during development). Only one 'for sale' or 'for rent' sign per parcel (max 5 sq ft) is permitted. No exterior TV/radio antennas without board approval.
- Assessments & fees: Annual assessments initially capped at $420 per lot, may increase up to 3% per year without a vote; higher increases require 2/3 vote of each class. Special assessments for capital improvements also need 2/3 vote. Assessments are levied uniformly and are a lien on the property. Delinquent assessments accrue 10% annual interest.
