Maricopa Power Center The Wells is a commercial shopping center in Sacate Village, AZ — not a residential community. This document is a supplemental declaration that imposes use restrictions and development requirements on a specific commercial lot (Lot 11), and a separate restrictive covenant limits hamburger restaurants on nearby lots for 20 years. It is not a rulebook for homeowners, but may inform commercial tenants or investors.
- Permitted uses (Lot 11): The Owner Parcel (Lot 11) may not be used as a hamburger restaurant (e.g., McDonald's, Five Guys), a financial institution (bank, ATM, insurance), or any medical use except a dentist office. Only one building is allowed.
- Building size & design approval: Any building on the Owner Parcel must not exceed 13,214 square feet floor area and 24 feet in height. The Developer must approve the plans (site plan, elevations, landscape) at least 45 days before construction, based on architectural harmony with the shopping center.
- Construction deadline & repurchase right: Owner must start construction within one year of the declaration date (December 2011). If not, Developer can repurchase the parcel within 180 days after the deadline. The repurchase price is the fair market value (or minimum the original price), determined by appraisal if not agreed.
- Environmental indemnity: Owner must indemnify Developer for any environmental claims or cleanup costs related to hazardous materials on the Owner Parcel, unless the contamination existed before Owner took title. Developer may record a lien to enforce reimbursement.
- Pylon sign & developer rights: Developer may build a pylon sign on the Owner Parcel; Owner has no rights to it. Developer decides which tenants appear on the sign.
- McDonald's restrictive covenant (adjacent lots): A separate restriction prohibits the listed lots (8, 9, 12, 13, 14) from being used as a hamburger restaurant for 20 years from March 2012. This benefits the McDonald's parcel (Lot 10). The covenant ends if McDonald's does not open within 4 years or ceases operation for 180 consecutive days.
