What Copper Hill Estates's governing documents say
Copper Hill Estates is a single-family home community in San Tan Valley, AZ, subject to a special covenant requiring membership in the Central Arizona Groundwater Replenishment District (CAWCD). This document adds water-supply fees and liens, not typical HOA rules.
- Water replenishment assessment: Each parcel is subject to an annual Replenishment Assessment based on groundwater use, levied by CAWCD to replenish excess groundwater. Unpaid assessments become a lien and personal obligation.
- Activation fee & reserve fee: An Activation Fee (per housing unit) and a Replenishment Reserve Fee (based on projected excess groundwater demand) must be paid to CAWCD before the sale or lease of any subdivided lot. These fees fund water supply infrastructure.
- Lien for nonpayment: If the Replenishment Assessment, Activation Fee, or Reserve Fee is unpaid, CAWCD gets a lien on the parcel and can pursue personal liability and remedies under Arizona law.
- What this document doesn't cover: This document only addresses groundwater replenishment obligations. It does not cover typical HOA topics such as architectural review, pets, leasing terms, parking, or common-area maintenance. Those rules, if any, would be in separate documents.
