Pike Az Properties is a small residential subdivision of three lots in San Tan Valley, AZ, governed by a Deed Restrictions & Road Maintenance Agreement filed by the developer and an adjacent owner. These rules bind all lot owners and cover use, animals, parking, fencing, and shared road maintenance, but there is no homeowners association or regular assessments.
- Use & commercial activity: Lots are for residential use only. No commercial activities except home occupations that are incidental, conducted indoors by occupants only, and do not change the residential character. Short-term rentals (Airbnb, VRBO) and timeshares are prohibited.
- Animals: Up to 10 animals per lot, including domesticated dogs and cats, and horses are explicitly allowed. Owners are liable for any damage or nuisance caused by animals. Declarant may impound animals running at large.
- Vehicles & parking: All motor homes, boats, RVs, and trailers must be parked in a garage or screened area, except for two RVs and two horse trailers per lot. Abandoned or inoperable vehicles (not driven for 3+ months) are prohibited unless stored in a garage for remodeling.
- Fencing & structures: Fences can be no higher than 7 feet, must be stained or painted to match the home, and maintained in good condition. Temporary structures (mobile homes, trailers) are not permitted except during construction. Prefabricated or manufactured homes are allowed on permanent foundations.
- Exterior antennas & noise: No exterior antennas except one 18-inch satellite dish and one 12-inch internet antenna. No exterior horns or sound devices except security alarms. No nuisance noise, excessive lights, or dust.
- Road maintenance & easements: All lot owners are jointly and severally liable for maintenance and repair of shared roads and easements. An owner causing damage through negligence must repair it. Common utility lines are owned as tenants in common.
- Amendments & enforcement: Amendments require approval of 66.66% of owners and the declarant. The declarant and any aggrieved owner may enforce the restrictions. Unpaid obligations create a lien on the lot with 18% annual interest, enforceable by foreclosure.
