What North Colony II's governing documents say
North Colony II is a single-family residential subdivision in Phoenix, AZ governed by a Homeowners' Association. You own your individual lot and must comply with association design standards, use restrictions, and per-lot assessments. The Association maintains common areas and enforces landscaping and architectural requirements.
- What you own & maintain: You own your lot and all improvements on it. You must maintain your lot in good condition, including landscaping per Front Yard Landscaping Standards; keep exterior areas visible from neighboring properties free of clutter; trim trees and shrubs so they don't overhang adjoining properties; and maintain walkways clean and dry. The Association maintains common areas and landscape maintenance areas.
- Association assessments: Annual per-lot assessments fund common area maintenance and a replacement reserve. Initial cap: $15/month per lot. After year one, assessments can increase up to 5% annually without member vote, or more than 5% with a 2/3 member vote. Assessments unpaid after 30 days accrue interest at VA mortgage rates and become a lien subordinate to first mortgages.
- Architectural review required: Any exterior modification—including painting, new structures, solar panels, or alterations—requires Architectural Control Committee approval before construction. The committee reviews plans, materials, colors, location, and grading.
- Residential use only; no business: All lots restricted to single-family residential dwellings. No commercial or business activities permitted. No trailers, tents, motor homes, or temporary structures may be used as residences.
- Setbacks, signs & exterior standards: Minimum 20-foot front setback from back of sidewalk to garage (18 feet for vertically opening doors). Only one 'for sale' or 'for rent' sign allowed per lot, maximum 5 square feet. Garbage cans, storage areas, and equipment must be screened from neighbor view. Garage doors must remain closed except when in immediate use for vehicles.
- Party walls: Each owner owns and must maintain the garden wall half closest to the center of their lot. The Association maintains the other half of garden walls and all perimeter walls surrounding the subdivision.
