What Klc Ranches's governing documents say
KLC Ranches is a single-family subdivision in San Tan Valley, AZ. This document is a supplemental covenant requiring all property owners to pay mandatory fees to the Central Arizona Groundwater Replenishment District (CAWCD) to maintain an assured water supply. It does not contain typical HOA rules such as architectural controls, pet limits, or leasing restrictions.
- Water replenishment fees: Each parcel is subject to a Replenishment Assessment (based on groundwater use), an Activation Fee (per housing unit), and a Replenishment Reserve Fee (based on projected excess groundwater demand). These fees are set by CAWCD and must be paid.
- Fee payments and liens: Unpaid Replenishment Assessments become a continuing lien on the parcel and a personal obligation of the owner at the time they were due. CAWCD has legal remedies for nonpayment, including interest, costs, and penalties.
- Amendment and binding effect: This Declaration runs with the land and binds all current and future owners. It can be amended only with the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area.
- What this document doesn't cover: This document does not address typical homeowner association rules such as architectural standards, landscaping, parking, pets, leases, or use restrictions. It is solely about groundwater replenishment fees and obligations.
