This document is a supplemental covenant for Idaho Creek Villas, attaching the property to the Central Arizona Groundwater Replenishment District (CAWCD). It is not a standard homeowners' association or condominium rulebook. Instead, it imposes mandatory water replenishment fees and liens on each parcel to help secure a certified water supply. This document binds all current and future owners of property within Idaho Creek Villas.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD to fund groundwater replenishment. The amount is based on the parcel's water usage and is a continuing lien on the property.
- Activation Fee: A one-time Activation Fee applies to each subdivision that qualifies as member land, payable before a public report is issued for sale or lease of subdivided lands. The fee is set by CAWCD per housing unit.
- Replenishment Reserve Fee: Category 1 member land parcels must also pay a Replenishment Reserve Fee, which is twice the Replenishment Reserve Charge multiplied by annual excess groundwater demand. This fee is due before a public report is issued and may be satisfied with long-term storage credits.
- Lien and Personal Obligation: All unpaid Replenishment Assessments, Activation Fees, and Reserve Fees create a lien on the parcel and are a personal obligation of the owner at the time the fee came due. CAWCD has legal remedies for nonpayment.
- Amendment Process: This Declaration may be amended only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area, or by changes to applicable statutes.
- What this document doesn't cover: This document does not contain typical community rules such as pet limits, leasing restrictions, architectural guidelines, parking rules, or amenities. Those would be found in a separate HOA or condominium declaration.
