What Skyline Ranch M's governing documents say
This is a Restrictions and Easements Agreement for the Skyline Ranch commercial shopping center, not a residential community. It governs commercial property owners, tenants, and Home Depot. This document does not apply to homeowners in the adjacent residential areas.
- Purpose of this document: This agreement sets easements and restrictions for a shopping center that includes a Home Depot, developer parcel, outparcels, and a major anchor parcel. It establishes shared rights and obligations among commercial property owners.
- Use restrictions: Only the Home Depot parcel (or a major anchor if owned by Target) may operate a home improvement store. Prohibited uses include flea markets, gun ranges, car washes (outside Home Depot zone), certain entertainment venues, and businesses generating offensive odors or noise. Some restrictions apply specifically to the Home Depot Zone of Control.
- Parking requirements: Parking minimums: 5 spaces per 1,000 sq ft of floor area on the Home Depot and Developer parcels; 4.75 spaces per 1,000 sq ft on major anchor parcels. Restaurant uses require higher ratios (10 or 20 per 1,000 sq ft depending on size). Employee parking must be on the employee's own parcel.
- Signage: Main free-standing signs are limited to Center Monument Sign(s), which may display Home Depot and up to 5 other businesses (each with at least 7,000 sq ft or on an outparcel). Outparcels may have one free-standing sign. No flashing or moving lights, and all signs must conform to approved design criteria.
- Maintenance obligations: Each owner must maintain the common area on its parcel, including paving, landscaping, lighting, storm drains, and signage. If an owner defaults, another owner may perform maintenance and bill the defaulting owner, plus a 15% admin fee, and may record a lien.
- Easements: Owners grant each other non-exclusive easements for ingress/egress, parking, utilities, and signage over common areas. Permanent drives and access points cannot be altered without consent of the affected zone owner (e.g., Home Depot in its zone).
- What this document does not cover: This document does not address residential rules for homeowners in Skyline Ranch M. It contains no provisions about pets, leasing, age restrictions, or homeowner assessments. It is a commercial property agreement only.
