41st Street South Condominiums is a 4-unit condominium community in Scottsdale, AZ. You own your individual unit and share ownership of common elements and a recreational area with an adjacent project. The association manages common areas and enforces rules.
- What you own & maintain: You own the interior finished surfaces of your unit's perimeter walls, floors, and ceilings. The association maintains all common elements (land, roofs, utilities, parking, recreational areas) and structural parts of limited common elements (e.g., patios, exterior doors/windows). You are responsible for maintaining your unit's interior, windows, doors, and any separate HVAC/water-heating units.
- Assessments & fees: Annual assessments are set by the board and initially capped at $900 per unit (prorated for partial years), payable in 12 monthly installments. Annual increases are limited to the greater of CPI or 10% (unless needed for utility/insurance costs). Special assessments require a 2/3 vote of members. Late payments incur a $15 late fee after 10 days and 12% annual interest after 30 days.
- Shared recreational area: The recreational common elements are shared with the adjacent 41st Street North Condominiums via a perpetual easement. The two associations split maintenance costs equally and must adopt identical rules and regulations for the area.
