What Casa De Cooper Office Condominiums's governing documents say
Casa de Cooper Office Condominiums is a non-residential (office) condominium community in Gilbert, AZ. You own your office unit and a fractional interest in the common elements. The association manages and maintains the shared areas and carries liability and property insurance. This community is for commercial office use only – residential, transient lodging, and timeshare uses are prohibited.
- Permitted use: Units may be used only for private commercial office purposes, including medical office. Residential, transient lodging, and timeshare uses are specifically prohibited.
- What you own & maintain: You own and must maintain the interior of your unit, including interior walls, floor coverings, ceiling finishes, and your HVAC equipment, glass, and window frames. You also maintain any exclusive-use patios or balconies. The association maintains all common elements (e.g., exterior walls, roof, parking areas, landscaping) and any parking spaces designated as limited common elements.
- Assessments & fees: Annual assessments are based on your unit's fractional interest (its square footage divided by total building square footage). The board sets the amount, but annual increases are capped at the greater of 12% or the CPI percentage increase (unless approved by 50% of members). Special assessments require a 50% vote of members. Late payments incur a 10% late charge and 24% annual interest.
- Architectural review: Any alterations or improvements to units or common elements must be approved by the Architectural Committee (or the Board if no committee is appointed). The document does not specify detailed design guidelines but grants the committee authority to adopt rules.
- Parking & vehicles: Parking spaces may be designated as limited common elements for exclusive use of specific unit owners. The association maintains all parking areas. The board may adopt parking rules, and the Parking Plan can be modified by the declarant or, after declarant control, by the board with unanimous member approval to create new exclusive spaces.
- Insurance: The association must maintain comprehensive general liability insurance with at least $1,000,000 combined single limit covering common elements, and property insurance for the buildings. Unit owners should carry their own insurance for interior improvements and personal property.
- Dispute resolution: Claims and disputes arising under the declaration or other project documents are subject to alternative dispute resolution procedures (Article XV). Exempt claims are specified, and enforcement follows the procedures in the declaration.
