- Bashas' lease term & renewals: Bashas' initial lease runs 20 years from the Rental Commencement Date, with four optional 5-year renewal periods available if no lease default exists at exercise time (total potential 40 years).
- Supermarket & deli exclusivity: No other grocery stores, supermarkets, bulk food sales (meat, fish, produce, dairy, bakery goods, cheese, lunch meats), or delicatessens are permitted in the shopping center while Bashas operates, plus for 12 months after Bashas stops operating such a business.
- Prohibited uses: Banned from the shopping center: massage parlors, adult bookstores/video stores, bars/cocktail lounges, theaters, bowling alleys, full gyms, churches, warehouses, car washes, auto/motorcycle sales, K-12 schools, hotels, dry cleaning with on-site plant, gas stations, convenience stores, and day care facilities.
- Building height & design: All buildings must be single-story or single-story with mezzanines only, with a maximum 35-foot height from finished floor (non-structural elements capped at 40 feet). All buildings must be first-quality construction within approved building envelopes.
- Parking & common area standards: Shopping center must maintain at least 3 sq ft of parking and common area per 1 sq ft of building area. Retail spaces require 5 parking spaces per 1,000 sq ft of leaseable space; restaurants require 10 spaces per 1,000 sq ft.
- Tenant approval authority: Bashas' has the right to review and approve all building plans for new buildings and material modifications in the shopping center before construction to ensure compliance with use, height, and quality restrictions.
