- Assessments & fees: Annual common area assessments, special assessments (if over 25% of budget must be approved by a majority of owners and Declarant), a $3,000/year management fee during Declarant control, and a $250 nonrefundable architectural review fee. - Dispute resolution: Disputes over budgets or assessments are resolved by arbitration with a single arbitrator experienced in commercial property management. Arbitration costs are borne by the non-prevailing party.
- Assessment liens & subordination: Unpaid assessments become a lien on the Lot, subordinated to first mortgages. Foreclosure purchasers take title free of prior unpaid assessments (which remain the personal obligation of the defaulting owner).
- Voting & Declarant control: Each Lot Owner votes in proportion to their Lot's square footage. During Declarant control, Declarant appoints the Board. After control terminates, Board members must be Lot Owners.
