It only changes the definition of 'Unit' — it does not contain the full community rules. The full CC&Rs were recorded in 2002, and this amendment was approved by the declarant and owners holding at least two-thirds of the votes.
- Unit definition & boundaries: The amendment redefines a 'Unit' as the building footprint, air space, fixtures, and improvements. The lower boundary is the bottom of the concrete slab; horizontal boundaries are the interior of exterior parametric walls. Interior walls, floors, ceilings, roofs, windows, and doors are part of the Unit. Any chute, flue, duct, wire, conduit, bearing wall, fire sprinkler system, or bearing column serving only that Unit is a limited common element; portions serving more than one Unit are common elements. Lighting fixtures fixed to the exterior or under a canopy are limited common elements allocated to that Unit.
