What Desert Mountain Club's governing documents say
This document is a Declaration of Covenants, Conditions and Restrictions for the Apache golf course parcel within the larger Desert Mountain master-planned community in Scottsdale, AZ. It restricts the use of the golf course land — not individual homes — to golf course and related uses, for the benefit of nearby homeowners and the homeowners' association. Readers should know this is an ancillary document governing only the golf course, not residential lots.
- Use restriction (golf course only): The property may only be used as a golf course (as defined by Arizona law) and for reasonably related improvements and uses such as clubhouses, pro shops, food service, guest facilities, tournament play, and landscaping/open space. No other uses are permitted.
- Enforcement & remedies: The Declarant (Desert Mountain Properties) or any person for whose benefit this Declaration is made may enforce the restrictions via injunctive relief and, if successful, recover court costs and reasonable attorneys' fees from the violating owner or occupant.
- Amendment & termination: The Declaration expires January 1, 2085, but can be extended for consecutive 25-year periods by the then-record owner(s). Amendments require Declarant consent and, in some cases, approval of two-thirds of the votes of benefited owners (excluding Declarant's lots). Certain minor deletions or extensions can be made by Declarant alone.
- Who is bound & benefited: The covenants run with the land and bind all present and future owners of the golf course property. The benefits extend to owners of adjoining subdivision lots that are also subject to the Desert Mountain Master Declaration, as well as any other property designated by Declarant.
- What this document doesn't cover: This document does not address residential lot rules, homeowner assessments, pet policies, parking, rental restrictions, or architectural review for homes. Those are governed separately by the Master Declaration and other community documents.
