Pinnacle Peak Shadows is a standard single-family homeowners association (HOA) in Scottsdale, AZ. These rules govern the use and maintenance of individual lots and common areas. This summary covers the key restrictions from the Amended and Restated Declaration and Bylaws, including a recent notice that the 30-day minimum lease term is unenforceable for owners who owned as of September 7, 2022.
- Single-family residential use: Each lot may have only one detached single-family residence, no more than one story, with a minimum floor area of 1,800 square feet (excluding porches, garages, patios). No prefabricated or temporary structures as residences, except during construction.
- Building & lot standards: Setback: front 35 feet, side interior 7 feet, side street 10 feet. Fences: maximum 3 feet in front, 6 feet at sides/back. Landscaping: minimum 6 trees per lot, front plan must be pre-approved. Roof materials limited to real shakes, shingles, masonry tile, or Bermuda roof, subject to Architectural Committee approval.
- Architectural approval: Any building, alteration, fence, or landscaping must be approved in writing by the Architectural Committee before construction. Plans are deemed approved if not acted on within 30 days. The Committee consists of at least one board member and other members appointed by the Board.
- Pets: Reasonable number of dogs, cats, or birds as household pets allowed, but no commercial breeding. Animals must be leashed when outside the residence or yard, and owners must pick up waste. No livestock or poultry.
- Leasing & rentals: Leases must be in writing, cover the entire lot, and include a provision that the lease is subject to the governing documents. Owners must provide tenant names, lease dates, and vehicle info within 10 business days. The original 30-day minimum lease term is invalid and unenforceable for record owners as of September 7, 2022; for all others, it remains in effect.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers in the street. Boats, motorhomes, and trailers must be stored out of street view. Inoperable vehicles must be stored in garage or removed within 48 hours. All vehicles must be registered with current tags.
- Assessments & fees: Maximum annual assessment as of Jan 1, 2021 is $554 per lot. Can increase up to 20% per year without member vote; above 20% requires 51% vote. Late fees: $15 plus 12% annual interest. Assessments are a lien on the lot. Special assessments for capital improvements require 51% member approval.
- Signs & nuisances: Signs allowed: political, caution, for sale/rent (per Arizona law), plus a residence identification sign, a small no-solicitation sign (2x4 inches), and others pre-approved by the Board. No noxious or offensive activities; the Board determines nuisances. Registered Level 2 or 3 sex offenders are prohibited from occupying any lot.
