This document establishes the rules for the community, including architectural control, use restrictions, and assessment obligations.
- What you own & maintain: You own your lot and home; you are responsible for all maintenance and repairs of your lot and home. The association maintains the common area (Tracts A, B, C) including entry wall, lighting, landscaping, street paving, curb and gutter.
- Architectural review: Any construction, exterior modifications, or landscaping changes must be approved in writing by an architectural committee appointed by the board, based on harmony and conformity. Plans must detail impact on natural desert vegetation; the committee may reject plans that adversely affect it. Approval is not automatic if no response within 30 days.
- Use restrictions: Property is exclusively single-family residential. Only one detached single-family dwelling (max one story, max 26 ft high) per lot. Minimum ground floor area: 3000 sq ft for 4-bedroom homes, 2200 sq ft for 3 or fewer bedrooms. Exterior must be Spanish, Southwest Indian, Mexican, or ranch-style. No reflective roofing, no visible roof-mounted appliances. No commercial or business use. Natural desert growth must be preserved except as needed for approved improvements.
- Parking & vehicles: No house trailer, mobile home, boat, camper, or truck over 3/4 ton may be stored on the property unless fully garaged and hidden from view. No vehicle dismantling or repair on driveways; parked vehicles must be operable. No chain link fencing visible from other lots or streets.
- Pets: Household pets are allowed but not for commercial purposes. No livestock, horses, cattle, sheep, goats, or poultry.
- Assessments & fees: Annual and special assessments are levied by the association at a uniform rate per lot. Initially, the maximum annual assessment is $400 per lot. Each owner pays one-fourth of total common expenses. Assessments are a lien on the property and a personal obligation. Delinquent assessments accrue interest at 15% per annum or maximum legal rate.
- Rentals & leasing: This document does not restrict leasing. Owners may delegate use of common area to their tenants. No minimum lease term is stated.
