Rancho San Carlos is a single-family home subdivision in Scottsdale, AZ, governed by a Declaration of Restrictions recorded by the developer. The rules apply to all lot owners and are designed to maintain a uniform residential character, with detailed requirements for construction, setbacks, and property maintenance.
- Land use & building type: Lots are for residential use only. No building other than one detached single-family dwelling (max 2.5 stories) with a private 3-car garage is permitted. No business, trade, or manufacturing is allowed, and no hospital or sanitarium for hire.
- Architectural review: All construction, alteration, or placement of buildings must have plans and specifications approved in writing by the Architectural Control Committee. Approval is deemed given if no decision is made within 30 days of submission.
- Building size & location: Dwellings must have at least 1,000 sq ft of floor area (excluding porches, garages, carports, patios). Setbacks vary by lot group: for most lots, front 30 ft, rear 25 ft, side street 15 ft (7 ft opposite street), interior 7 ft. Lots 58–70 have larger setbacks (front 40 ft, rear 35 ft, etc.). No prefabricated buildings are allowed except temporary contractor structures.
- Fences & walls: Fences and walls must be approved by the Architectural Control Committee. Maximum height is 6 ft, except within minimum setbacks where they cannot exceed 2.5 ft. No fence or wall higher than 6 ft across the rear property line.
- Pets & livestock: No livestock or poultry may be raised or kept, except dogs, cats, or other household pets not kept for commercial purposes. Horses may be kept for single-family use with county approval and Committee consent.
- Vehicles & parking: No abandoned or inoperable vehicles may be stored on any lot visible from other lots or streets. Overnight parking of trucks, pickup trucks, or trailers in the street is prohibited. Boats, trailers, and other equipment cannot be parked in front areas without Committee approval. Only passenger cars and pickup trucks may be parked in open carports or driveways.
- Maintenance & nuisances: All lots must be kept free of rubbish and weeds. Improved properties must be maintained in a neat and sightly condition. No noxious or offensive activity is allowed. Six neighbors may clean up an unkempt lot and impose a lien for costs.
- Enforcement & duration: These covenants run with the land for 30 years from recording (1979), with automatic 10-year extensions unless amended by majority of lot owners. Any lot owner may enforce via lawsuit for damages or injunction.
